General terms and conditions

​​1 - TERMS AND CONDITIONS OF THE CONTRACT:

The Owner consents to this contract and entrusts the Petsitter with his animal, who must take care of him.

This contract is concluded for a determined period and could be revised beyond this period.

This contract is only valid for the mentioned Stakeholders, and is subject to French law.

The signing of this contract means both Stakeholders agree on the conditions named in it.

 

2 - TERMS AND CONDITIONS OF THE RESERVATION PROCESS:

The Owner initiates an oral or written reservation request to the Petsitter.

The Owner has 3 days to sign the contract as soon as the Petsitter gave him access to it.

If the Owner already signed the contract for the calendar year, the Owner commits to carrying out the payment the day of the approval of the reservation request by any written means by the Petsitter.

If the Owner signs the contract for the first time of the calendar year, he commits to carrying out the payment the day of the signing of the contract.

Awaiting the payment and the signing of the contrat, an option is taken on the reservation. If the conditions set out above concerning the signing of the contract and the payment are not met, the option is removed and the care isn’t considered as reserved anymore.

Once the payment is received by the Petsitter, the reservation is guaranteed.

If the Petsitter hasn’t received the payment before the 1st day of the care, he reserves the right to refuse to take the animal.

 

3 - TERMS AND CONDITIONS OF PAYMENT:

The Owner commits to paying 100% of the amount due to the Petsitter the same day of the validation of the reservation by the Petsitter or the same day of the signing of the contract according to the conditions stated on paragraph 2 - TERMS AND CONDITIONS OF THE RESERVATION PROCESS, and before the first day of the care, by wire transfer or by cash.

If the Owner pays by wire transfer, he commits to sending the Petsitter a proof of payment on the same day the wire transfer is made.

If the Owner pays in cash, he commits to giving the sum of money to the Petsitter (in person or in his mailbox) within 5 days following the validation of the reservation by the Petsitter or the signing of the contract.

In the event of non-payment, the Petsitter reserves the right to start legal proceedings.

VAT is not applicable on services provided by Anidays.

 

4 - PRICES:

From 01/01/2024 to 12/31/24, the following prices will be applied to the services mentioned below:

4.1 - Prices for the visits and walks service

4.1.1 - Off-season prices:

  • 30mins visit and/or walk: 15€

  • 1h visit and/or walk: 23€

  • Visit and/or walk of more than 1h: on quotation

4.1.2 - High season prices:

  • 30mins visit and/or walk: 20€

  • 1h visit and/or walk: 30€

  • Visit and/or walk of more than 1h: on quotation

The high season period includes weekends, holidays (from 12/15 to 01/15, from 02/15 to 03/15, from 04/15 to 05/15, from 06/15 to 09/15, and from 10/15 to 11/15) and public holidays (04/01, 05/20).

Travel expenses are added if they’re superior to 1€ for the round-trip, and are calculated with the website “viamichelin.fr” and the Public Service kilometer scale applied to cars in 2024.

A 10% discount is applied for 10 successive visits/walks.

4.2 - Prices for the home care service (day care)

4.2.1 - Off-season prices:

  • 20€ a day for a dog

  • 12€ a day for a cat

  • 5€ a day for an exotic animal

4.2.2 - High season prices:

  • 26€ a day for a dog

  • 16€ a day for a cat

  • 7€ a day for an exotic animal

These prices are valid for a 9 a.m. to 6 p.m day.

For any additional hours started outside this time slot, €2 per hour will be added, whatever the season.

The high season period includes weekends, holidays (from 12/15 to 01/15, from 02/15 to 03/15, from 04/15 to 05/15, from 06/15 to 09/15, and from 10/15 to 11/15) and public holidays (04/01, 05/20).

A 10% discount is applied for 10 days reserved in a 2 month period.

4.3 - Prices for the home care service (night included)

4.3.1 - Off-season prices:

  • 35€ a day for a dog, 20€ for an extra dog

  • 20€ a day for a cat, 12€ for an extra cat

  • 10€ a day for an exotic animal, 6€ for an extra exotic animal

4.3.2 - High season prices:

  • 40€ a day for a dog, 23€ for an extra dog

  • 23€ a day for a cat, 14€ for an extra cat

  • 12€ a day for an exotic animal, 7€ for an extra exotic animal

The high season period includes holidays (from 12/15 to 01/15, from 02/15 to 03/15, from 04/15 to 05/15, from 06/15 to 09/15, and from 10/15 to 11/15) and public holidays (04/01, 05/20).

A 5% discount is applied for 7 successive days of home care and more, 10% for 14 days and more and 15% for 21 days and more.

4.4 - Prices for a private care applicable to home care services (day care and night included)

4.4.1 - Off-season prices:

  • 75€ a day (for 3 dogs ou cats maximum)

4.4.2 - High season prices:

  • 86€ a day (for 3 dogs ou cats maximum)

To determine the high season period, please refer to the home care services mentioned above.

 

5 - GUARANTEE:

The first day of the care, the Owner commits to providing the Petsitter with a 150€ guarantee (check or cash). It will be used for covering damages that may be caused by the animal, for paying the potential veterinary costs for an accident or disease, or for the potential food or accessory purchases needed to make sure the care runs smoothly.

A prior agreement will be given by the Owner to the Petsitter before carrying out these expenses.

This guarantee will not be banked if no expense is necessary or no damages has been committed, and will be returned on the last day of the care.

 

6 - CANCELLATION CONDITIONS:

6.1 - Cancellation by the Petsitter:

If the Petsitter cancels the care, he commits to letting the Owner know 7 days before the beginning of the care at the latest. If the period is shorter, the Petsitter commits to doing his best to go ahead with the care.

In that case, the Petsitter commits to reimbursing the total amount of the care paid by the Owner.

6.2 - Cancellation by the Owner:

If the Owner cancels more than 2 months before the beginning of the care, the Petsitter will pay back a 100% of the amount of the care to the Owner.

If the Owner cancels less than 2 months and more than 1 month before the beginning of the care, the latter consents to the Petsitter retaining 10% of the amount of the care.

If the Owner cancels less than a month and more than 15 days before the beginning of the care, the latter consents to the Petsitter retaining 30% of the amount of the care.

If the Owner cancels less than 15 days and more than 7 days before the beginning of the care, the latter consents to the Petsitter retaining 50% of the amount of the care.

If the Owner cancels less than 7 days and more than 48h before the beginning of the care, the latter consents to the Petsitter retaining 70% of the amount of the care.

If the Owner cancels less than 48h before the beginning of the care, the latter consents to the Petsitter retaining 100% of the amount of the care.

The only reasons justifying a full reimbursement by the Petsitter are the Owner being sick (prescription must be provided) or the animal being sick (proof of veterinary costs must be provided).

If the Owner decides to shorten the duration of the care after it has already begun, no reimbursement will be made by the Petsitter.

 

7 - RIGHT TO WITHDRAWAL:

The Stakeholders acknowledge by a general agreement that they both have 15 days to withdraw from the contract, starting from the signing of the contract.

 

8 - PUNCTUALITY:

The Owner and the Petsitter commit to being on time for the first meeting, when dropping off and when picking up the animal.

 

9 - UNUSUAL BEHAVIOR:

If the animal turns out to be aggressive or presents any unusual behavior making it impossible for the Petsitter to keep him, the Petsitter will have the right to terminate this contract without notice. In that case, the Owner will have to pick up his animal or find a solution at his expense in a 48h interval after the Petsitter’s announce to the Owner. If the Owner doesn’t do so, the animal will be placed in a refuge such as the Society for the Protection of Animals (SPA).

The Petsitter will retain 100% of the amount of the care.

If the Petsitter faces any difficulty with the animal during the care, he commits to letting the Owner know immediately.

 

10 - ABANDONMENT:

The Owner understands and acknowledges that if he doesn’t respect the end dates settled with the Petsitter at the time of the reservation, his animal will be considered abandoned. He will consequently be placed in a refuge such as the SPA.

 

11 - PRIVACY:

The Petsitter commits to respecting the Owner’s private life and not disclosing any personal information. For more information about personal data used on Anidays' website, please check the Legal notices on www.anidays-petsitting.com, accessible from the footer.

 

12 - INSURANCE:

The Petsitter certifies being the holder of a professional liability insurance.

The Petsitter cannot be held responsible for injuries that the animal may inflict on himself or third parties.

The Petsitter cannot be held responsible if the tied-up animal of the Owner is attacked by another animal.

The Owner is required to have home insurance. The Petsitter cannot be held responsible for a break-in, damages caused by the animal or poor maintenance of the Owner's home during the care, nor after the care for the visits and walks service.

 

13 - HEALTH:

The Owner commits to keeping his animal's health record up to date (vaccinations, antiparasitics, etc.). The Owner especially commits to being up to date on the rabies vaccine (for categorized dogs or if the animal traveled abroad) and kennel cough.

The Petsitter reserves the right to refuse to take in the animal if this rule is not respected, and declines all liability in the event of the animal’s illness which could have been contracted at the Petsitter's home.

In case of veterinary emergency:

  • The Owner is required, before the care, to inform his usual veterinarian (if he has one) that his animal will be entrusted to the Petsitter.

  • The Owner is required to leave his animal's health record available to the Petsitter at the beginning of the care. This will allow the veterinarian to have all the necessary information on the animal if necessary.

  • The Petsitter will pay the veterinarian directly with the guarantee provided for this purpose and by the Owner at the start of the care. The Owner commits to reimbursing within 24 hours any additional veterinary costs incurred by the Petsitter that the deposit cannot cover.

  • The Petsitter is authorized to drive the sick or injured animal to the veterinarian recommended by the Owner (if no veterinarian has been previously recommended, he may be chosen by the Petsitter).

  • The Petsitter commits to obtaining an agreement from the Owner (or the emergency contact indicated by the latter in this contract) before incurring medical expenses. If a serious danger is entailed by the animal and requires immediate medical intervention, or if the Owner or the emergency contact cannot be reached, the Petsitter is authorized to decide to incur the veterinary costs that he considers necessary for the good health and protection of the animal.

  • The Petsitter cannot be held liable in the event of the death, injury or illness of the animal during the care, nor after the care.

14 - LITIGATION SETTLEMENT:

These terms and conditions are subject to French law.

The court of competent jurisdiction is the commercial court of Salon de Provence, France.

The Owner is entitled to call on a mediator for free. The Petsitter has appointed the following consumer mediator:
